Terms of use and sale of DJUD. They apply to anyone who uses the site; by creating an account, you accept them. Questions: djud.contact@gmail.com.
1. The service
DJUD is a social network and marketplace for students and young creators from art, fashion and design schools: they show their work there (profile, portfolio, Feed) and sell their pieces. DJUD puts members in touch: it is neither the maker nor the seller of the pieces, and each sale is made directly between the buyer and the seller. For content published by members, DJUD acts as a host (French law no. 2004-575 of 21 June 2004, art. 6); for sales, as an online platform operator (French Consumer Code, art. L111-7).
2. Your account
- The site is for people aged 15 and over. To sell, you must be an adult or have your parents’ consent.
- An account is personal. You are responsible for your password and for what is done with your account.
- The information on your profile must be accurate, especially your school and your seller status.
- You can delete your account at any time: Settings → Delete my account.
3. What you publish
- You only publish your own work, or work for which you hold all the rights.
- People who can be recognised in your photos have agreed to appear in them.
- The following are forbidden: counterfeits and copies; illegal, hateful, violent, discriminatory or sexual content; harassment; personal contact details; outside payment methods; and any advertising unrelated to your work.
- You keep all your rights. You grant DJUD a free, non-exclusive permission, limited to the time the content is published, to display your content on the site in order to run the service.
4. Reporting and moderation
- Anyone can report content that is illegal or breaks these rules: the “Report” button on comments and conversations, or an email to djud.contact@gmail.com (address of the page, reason, your contact details).
- DJUD does not monitor content in advance, but reviews each report diligently and promptly removes anything that is manifestly illegal.
- When content is removed or an account is restricted, the person concerned is told, with the reasons for the decision, unless there is an emergency or a legal prohibition. They can contest it by replying to that email: the appeal is reviewed by a person, and the decision is confirmed or reversed.
- An account that repeatedly publishes manifestly illegal content, or abuses reports, may be suspended for a reasonable period, after a warning.
- Each member can block another member from the messages.
5. Selling a piece
- Only pieces you made yourself may be put up for sale, with an accurate description (photos, materials, dimensions, condition).
- You state your seller status: individual (occasional sale of your own pieces) or professional (with your SIRET number). It is shown to buyers on each of your pieces.
- A professional seller follows the rules for selling to consumers: pre-contract information, a 14-day right of withdrawal and the legal guarantees of conformity and against hidden defects.
- Each piece sold comes with a certificate of authenticity that you sign before shipping: you attest that the piece is an original creation you made and that its details are accurate. An inaccurate certificate engages your liability; it is cancelled if the sale is refunded.
- Once the piece is paid for and its certificate signed, you ship it within 5 days to a relay point, with the label provided, and enter the tracking number.
- Your income: money from your sales may be taxable and subject to social contributions. Find out more on impots.gouv.fr and urssaf.fr. Like any sales platform, DJUD must report each year to the French tax authorities the details of sellers who made at least 30 sales or €2,000 in sales during the year (French General Tax Code, art. 1649 ter A), and send them a copy.
6. Buying and paying
- The total price is shown before payment: the price of the piece, delivery to a relay point, and payment and protection fees (1.5% of the amount + €0.25), which cover the payment provider’s fees. DJUD takes no commission on sales.
- Payment is made only online, through our provider Stripe: DJUD never sees your card number. Any payment outside the site is forbidden and is not protected.
- The money is held until the buyer confirms receipt (or, without a complaint, until the date shown on the order), then paid to the seller. The refund and dispute rules are set out on the Returns, refunds and disputes page.
7. How content is ranked
- The “Discover” Feed shows posts from newest to oldest; “Following” is limited to the students you follow.
- The Shop shows the most recently published pieces by default; you can sort them by price and filter them by category.
- Search ranks results by how well they match the words typed (title and name first, then description).
- No member pays to be ranked higher. Demonstration content is marked “Example”.
8. Liability
DJUD does its best to keep the service running, but cannot guarantee permanent availability. Each member is responsible for what they publish and for the sales they make. DJUD is only liable for content published by members if it did not act promptly after being informed of it.
9. Personal data and cookies
See the privacy policy and the cookie policy.
10. Changes to these terms
These terms may change. You are notified on the site at least 15 days before a significant change takes effect; you can then delete your account if you do not accept it.
11. Disputes and applicable law
These terms are governed by French law. If there is a problem, first write to djud.contact@gmail.com: an amicable solution will be sought.
If you are a consumer, you can use the consumer mediator free of charge: [to be completed], after a written complaint that has not received a satisfactory answer. In all cases, you may still bring the matter before the competent court.
